Support Plan Terms and Conditions

The following outlines the terms of use for WordPress Support from Westside Virtual, Inc.

DESCRIPTION OF SERVICE
Westside Virtual, Inc. will provide WordPress Support for Client’s site including plugin, theme, and core software updates, backups, site optimization of database, spam comment clearing, and regular security scans. Client acknowledges that these updates will be performed weekly throughout the month with no guaranteed date or time of service.

DISCLAIMER
Westside Virtual, Inc. will not be held responsible for any user caused errors or errors caused by poor administrative practices such as addition of conflicting plug-ins, editing or adding new code, etc, or web hosting changes.

Client understands and agrees that temporary interruptions of the services provided by Westside Virtual, Inc. may occur as a normal part of service. Client further understands and agrees that Westside Virtual, Inc. has no control over Client’s web host or any third party networks Client may use in the course of the use of this site or our services, and therefore, delays and disruption of such networks are completely beyond our control.

Client understands that all web hosts are different and that all of our services may not work with every host setup. If settings on Client host server change during Client account period with us, that may affect our services.

PAYMENTS
Payments will be automatically charged each month on the date of sign up. Client may login and cancel account at any time. All services will end upon cancellation.

GOVERNING LAW
Westside Virtual, Inc. does not make any warranty, express or implied, and Client specifically waives any warranty of merchantability or fitness for a particular purpose. In no event will Westside Virtual, Inc. be liable to Client or any third party for any damages, including but not limited to any lost profits, lost savings, or other incidental, consequential, or special damages arising out of the operation of or inability to operate the website even if Westside Virtual, Inc. has been advised of the possibility of such damages.

Regardless of the place of signing of this agreement, Client agree that for purposes of venue, this contract was entered into in Indiana and any dispute will be litigated in a court of competent jurisdiction in New York County, New York.
